Many law firms claim to have the answers to all of their clients legal issues; we do not.  The Law Office of Hans Christian Beyer, P.A. specializes in representing our clients primarily in one area of law:  complex commercial bankruptcy litigation.  This litigation usually arises in the context of Chapter 11 Reorganizations, assignments for the benefit of creditor proceedings, or out-of-court restructurings.  We have extensive experience in all facets of commercial bankruptcy cases and out-of-court restructurings including litigating fraudulent transfer and preference actions; negotiating and drafting complex reorganization plans; out-of-court workouts; and assisting clients with foreclosures, replevins, garnishments, and other bankruptcy-related federal and state court proceedings.

Although Mr. Beyer has represented various types of clients over the years (including large business debtors and national and international financial institutions), the firm’s typical client is now a bankruptcy trustee, a creditors committee, a liquidator, or a commercial creditor.  On occasion, the firm will also represent commercial debtors on a selective basis or work as special or local counsel alongside a debtor’s bankruptcy counsel.  Within the bankruptcy litigation arena, we are particularly experienced in prosecuting fraudulent transfer cases and other avoidance actions and in locating, freezing, and recovering assets which have been hidden, often in offshore jurisdictions.

Over the years, the firm has spent an ever-increasing amount of its resources representing official and ad hoc creditors’ committees in cases involving a variety of industries including manufacturing, agriculture, hospitality, automotive, and finance.  The experience gained from such varied representations permits us to address and coordinate the often divergent goals and interests of the different creditors represented by a committee.  The same experience also permits us to aggressively negotiate settlements to meet those client goals.  While our history of success at the negotiating table is impressive, we will not hesitate to resort to litigation when necessary or desirable.  We pride ourselves upon the firm’s significant successes in a variety of courtrooms as well as at the negotiating table.
