Significant Engagements

The following list summarizes some of the major engagements handled by Hans Beyer. While many of these engagements were handled through the Law Office of Hans Christian Beyer, P.A., the remainder were handled by Mr. Beyer while he practiced law as a partner with other law firms.

  • Ernie Haire Ford, Inc.
    Tampa, Florida.    Counsel  for  Official  Committee  of  Unsecured Creditors  and  its  post-confirmation successor the Liquidating Agent.  Primary responsibility  for investigation into potentially improper transfers of millions of dollars involving fraudulent transfers.  Lead trial counsel for all related litigation.  Assisted in negotiation and confirmation of reorganization plan.  Conducted bankruptcy auction of substantially all of debtor’s assets.

  • Duratek Precast Technologies, Inc. & Duratek Precast Structures, LLC
    Tampa,  Florida.   Counsel  for  Official  Committee  of Unsecured Creditors.   Worked with secured creditors, unsecured creditors, and debtors’ principal to negotiate a sale of substantially all of the two debtors’ assets for the benefit of creditors.
    October, 2010 – August, 2011.
  • Kearney Construction Co.
    Tampa, Florida.  Counsel to developer of significant multi-use real estate project.  Handled litigation and negotiations with respect to complex set of cross-claims related to development, for which the Chapter 11 Debtor was the general contractor.

  • Meres Crossing Multi-Use Development
    Tarpon Springs, Florida.  Acted as developer’s lead counsel in connection with all phases of a substantial multi-use commercial development.

  • Phoenix Restructuring Group, LLC / 5215 Development, Inc.
    Tampa, Florida.  Counsel for Official Committee of Unsecured Creditors in administratively consolidated cases involving negotiation of reorganization plan for chain of video rental stores.

  • Florida Grande Motor Coach Resort, Inc.
    Tampa, Florida.  Counsel for principals of real estate development valued at over $20 million; handled litigation relating to same and complex negotiations of “global” settlement agreement involving clients and various other parties along with reorganization plan.
    Plan confirmed in 2008.  2007 – 2010.
  • In re Arthur Nadel
    Naples, Florida.  Represented creditors in connection with SEC receivership and complex tax issues relating to receiver’s claw back rights in the context of a Ponzi scheme.

  • Evergreen Security, Ltd.
    Orlando, Florida.  Counsel for creditors’ committee and thereafter for its successor the steering committee in bankruptcy reorganization of British Virgin Islands company doing business as a Bahamian mutual fund.  Oversaw certain asset discovery and recovery activities; created creditor information web site; and assisted in coordination of complex, multi-national litigation seeking to recover over $200 million stolen from investors through fraudulent transfer (Ponzi Scheme), deepening insolvency, and other causes of actions.  Drafted reorganization plan which was confirmed.

  • International Administrative Services, Inc. (f/k/a The Charles J. Givens Org.)
    Orlando,  Florida.     Counsel   to   the   Official   Committee  of  Unsecured  Creditors and thereafter to its successor reorganization trustee.  In addition to performing the typical duties of committee counsel in a large reorganization case, had primary responsibility for investigating, commencing, and coordinating ongoing litigation and appeals in U.S. Bankruptcy Court in Orlando, FL; U.S. District Courts in San Diego, CA, and Orlando, FL; Eleventh Circuit Court of Appeals, Atlanta, GA; and the Royal Court of Guernsey, Channel Islands seeking over $150 million in damages through fraudulent transfer, RICO, and other causes of action.  Plan confirmed in 1997; prevailed in final appeal after oral argument before the Eleventh Circuit Court of Appeals in 2006.

  • Far & Wide Communication Companies
    Miami, Florida.  Represented lead bank in large syndicated loan in complex reorganization proceeding.
    2003 – 2004.
  • Gardner Industries, Inc. and various affiliated corporations
    Miami, Florida; Tampa, Florida; Cleveland, Ohio.  Represented eleven affiliated corporate debtors which were one of the country’s largest manufacturer of asphalt products for roofing and driveway applications.  Plan confirmed in 1993.  Had primary responsibility for negotiating and implementing a successful out-of-court financial restructuring in 1996.  Lead bankruptcy counsel for Gardner’s 2000 acquisition of the Gibson-Homans Company through a bankruptcy auction in Illinois.  Continued to act as special bankruptcy and litigation counsel to the companies for many years.

  • Shaw Aero Devices, Inc.
    Ft. Myers, Florida; Tampa, Florida; Naples, Florida.  Counsel for Official Committee of Unsecured Creditors in bankruptcy reorganization of major manufacturer of aircraft parts and replacement parts for heavy machinery.  Case successfully confirmed.  Represented the creditors’ committee’s successor, the Steering Committee, post-confirmation to protect rights of unsecured creditors.

  • Cypress Foods, Inc.
    Tampa, Florida.  Counsel for Official Committee of Unsecured Creditors in Chapter 11 liquidation of one of the largest poultry producers in the United States.  Represented committee during case and handled post-confirmation litigation for Chapter 11 Trustee.
    Plan confirmed 2003.  2002 – 2004.
  • Servico, Inc. and various affiliated corporations
    Miami, Florida.  Assisted in representation of sixty-seven debtors and non-debtor affiliates in complex reorganization involving over fifty hotel properties operating under various corporate flags. Recovered approximately $150 million in fraudulent transfers from shareholders and affiliates and confirmed a plan of reorganization.
